5,000 residents to vacate, as Noida’s Supertech Twin Towers to be Demolished on August 28

New Delhi, Aug 19, (LAB) Pursuant to the Supreme Court’s orders to demolish the illegally constructed Supertech twin towers in Sector 93-A of Noida, more than 5,000 residents from the adjoining societies will vacate the premises.

Residents of The Emerald Court and ATS Village societies which are close to the Twin towers and over 2,500 vehicles will be removed from there on August 28 – the day of demolition

Each of the two illegally constructed towers will be brought down with the help of explosives weighing about 3500 Kg.

The evacuation plan states that the residents of nearby Emerald Court and ATS Village will have to vacate the premises by 7.30 am on August 28 and can return after 4 pm only with safety clearance from Edifice.

There are approximately 650 flats in Emerald Court and 450 flats in ATS Village. Both societies have a combined number of residents over 5,000 who will be required to move out as per schedule on August 28, All vehicles will have to be removed from the two societies as well for the said period.

As for the removal of vehicles, several residents have more than one vehicle. There are around 1,200 vehicles in Emerald Court and 1,500 vehicles in ATS Village that will have to be moved outside. The Noida Authority will provide space for them in the multilevel parking facility at the Botanical Garden metro station which is said to accommodate more than 5,000 vehicles at a time.

Entry of people, vehicles and animals will be also be restricted in the close proximity area — known as exclusion zone — of the twin towers in Sector 93A.

The infamous Supertech twin towers were constructed in Sector 93-A of Noida in violation of the building bye-laws. The Noida-Greater Noida Expressway, which is close to the twin towers, will remain shut for vehicular movement from 2.15 pm to 2.45 pm on that day.

Fire tenders, ambulances, etc, required for emergency services, shall be parked on the road constructed behind the park in front of the twin towers.

The Apex court had ordered the demolishing of the Twin towers as the builder Supertech had not taken the permission of the residents of the society and very little space was left in between the two towers which could lead to serious safety concerns. No space was left in between the towers that even a fire brigade could enter the area in case of any fire or mishap happens.

According to the 140-page order of the court, “the sanction given by NOIDA on 26 November 2009 and 2 March 2012 for the construction of T-16 and T-17 is violative of the minimum distance requirement under the NBR 2006, NBR 2010 and NBC 2005.”

The apex court also observed that the construction of T-16 and T-17 was in violation of the UP Apartment Act, as the owners did not take the consent of flat owners, which was mandatory under the said act. The construction of these twin towers led to the reduction in the common area, observed the top court.

The order also added, “the case has revealed nefarious complicity of the planning authority in the violation by the developer of the provisions of law…The suggestion that the twin towers from part of one block were an afterthought.”

The top court also ordered that the flat buyers were to get a refund with 12 per cent interest by Supertech. and also asked the builder to bear the cost of demolition of the illegally constructed towers and to pay Rs 2 crore to the Supertech Emerald Court Residents Welfare Association (RWA).

Advocate Gaurav Agrawal, who was appointed as Amicus Curiae in the case, had earlier suggested that the demolition has to be carried out by a special agency as many residential towers are also in close proximity to these twin towers and their safety concerns have to be taken into consideration./LAB/SNG/
